The commission said on Tuesday that competitors competing for MP should have degrees and that the choice must be switched by the court.

In a letter reacting to UDA Secretary General Veronica Maina, IEBC CEO Marjan Hussein said the law expecting MPs to have degrees is as yet in power.

"Except if announced unlawful by the Court, the degree necessity for Members of Parliament is in power and is worn out regulation," he said.

"Segment 22 of the Elections Act, 2011 addresses the prerequisite of Members of Parliament and Members of the County Assembly to have a degree from a college perceived in Kenya. This regulation is in power for the reasons for the General Election 2022."

Maina had kept in touch with the Commission mentioning for data on capabilities and prerequisites for up-and-comers across every single elective post.

IEBC said there is no instructive necessity as for MCA hopefuls after the High Court, in a judgment on protected appeal No. E229 of 2021 on October 15, 2021, pronounced area 22(1)(6)(i) of the Elections Act illegal.

"For lucidity, the Court really invalidated the prerequisite that an individual should have a degree from a college perceived in Kenya to fit the bill to be a Member of a County Assembly."

The appointive body proceeded to say that hopefuls for the place of President, Deputy President, Governor, and Deputy Governor should have a degree from a college perceived in Kenya.

The law, whose execution date has been delayed a few times, is set to produce results in the August decisions. Individuals from the National Assembly in 2017 altered segment 22 of the Election Act that endorsed least scholastic capabilities for administrators at the two degrees of government.

Onesmus Kimani Ngunjiri is one lawmaker who will confront the hatchet in the event that for sure the law happen. In addition to the fact that he has no degree, yet some have even given occasion to feel qualms about his Secondary School endorsement.
